WHEN THIS PRIVACY STATEMENT APPLIES. This Privacy Statement (“Statement”) explains how we, Revolution Business Services, LLC (“Revolution,” “we,” “us," or “our”) collect, use, share, or otherwise process information that we collect through our Services for purposes not otherwise specified or addressed in a commercial agreement or contract by and between you and us. “Services” is defined to include our websites, products, software-as-a-service offerings, mobile applications, marketing activities, and similar.

WHAT WE DO WITH YOUR INFORMATION. We respect your privacy and strive to ensure we are clear about what information we collect and how we use that information. Specifically, we will use your information to provide and operate our business and Service, including for the purposes of helping make our Services more effective, easier to use, smarter, and better for you. Additionally, we do not intentionally or negligently sell or share your Personal Information with third parties for their own commercial uses, for monetary or other valuable consideration without your consent.

TYPES OF INFORMATION WE COLLECT. In connection with accessing our Services, we may collect information:

You Provide to Us

  1. Contact data and account profile data. We collect information when you (or your organization) create an account, activate a subscription, and/or upload information to our Services. Personal information may include your name, previous name(s) and/or nicknames, title and honorifics, professional title and company name, education, billing and mailing addresses, phone number and email address, profile photo, billing information (your payment information), purchase history, demographic information, preferences, subscription data, and your username and account credentials.
  2. Identity verification information. We collect information to verify your identity, which may include, but not be limited to, your name, date of birth, social security number, social insurance number, driver’s license number, passport number, government-issued identification details, and/or similar information to verify your identity and to help you complete payroll-based tasks.
  3. Communications, feedback, survey, and related data. We may collect personal information such as your name, email address, telephone number and any other personal information you choose to share when you reach out to us for support, give us feedback, participate in optional surveys, attend our events, participate in product research or training, or otherwise interact or communicate with us. This information may include: support call recordings and monitoring records, chat and text records, voicemails, photographs, and video images.
  4. Marketing data. We may receive contact information and preferences for receiving marketing communications from you.
  5. Social and community content. We receive content you post on our social media pages and our community pages.
  6. Business and financial information. We may receive information about your business, your finances, expenses, invoices, financial statements, details of your financial transactions, payroll details, payment details, tax return details, details about your customers, vendors, or employees, income and wage information, and/or investment information.
  7. Interactions with chatbots. We may receive information from you through your optional and voluntary use of chatbots, digital assistants, or other interactive bots made available on our Services.
  8. Device and contact data. If you grant permission in your device     settings, certain features may have access to your device and contacts.

From Third-Party Sources
Our Services are designed to help you do your best work in the entertainment and production space which includes helping you connect with other people and businesses. As a result of those connections, others may be able to input personal information about you. For example, a Revolution customer may share personal information about you with us in order to use and benefit from the Revolution Services. You also may be able to input or process personal information about others, for example, if you are an account administrator of one of our products or use Revolution Services to invite users to our systems in the course of business. If you input information about others into the Services, you must only do so if you have first provided sufficient notice, received any required permissions, and/or maintain legal basis, as applicable. 

We may also receive personal information about you from other third parties where you have provided consent, lawful basis otherwise exists, or where otherwise permitted by applicable law. We protect and process the personal information obtained from those third parties as described in this Statement, consistent with any additional restrictions imposed by the source of the information. Our third-party sources may vary over time and depend upon how you use the Revolution Services. For example, we receive information from:

  1. Supplemental information and identity verification providers. We work with certain third parties to help us verify your identity, the specifics of your business, and/or supplement the personal information you have provided and ensure the accuracy of your personal information. For example, we may use third-party providers to validate your contact information (e.g., name, mailing address, email address, phone number) or to provide additional details about your business. Information may be used by these providers taking into account information from, for example, your financial institution, telecommunications provider, or email provider.
  2. Customer support providers. We receive personal information about you or your interaction with the Revolution Services from certain third parties for troubleshooting purposes. For example, we may obtain information about your interaction(s) with customer support and information about technical issues you have raised, including call center recordings, call monitoring records, voicemails, photographs, and chat records.
  3. Other users. As described above, we may receive personal information     about you from other Revolution Services users, such as your accountant, bookkeeper, tax preparer, spouse, employer, or other business customers using the Revolution Services (e.g., businesses from which you buy     products or services, or with which you otherwise interact). We may also collect such personal information through features like member referral programs.
  4. Risk management, cybersecurity, and anti-fraud providers. We may receive personal information from third parties that help us assess risks associated with our offerings, including to help combat fraud and illegal activity and to help protect your personal information.
  5. Data providers. We may receive information from information services and data providers that give demographic and preference information to us.
  6. Content providers. We may receive personal information from companies that make user-generated content from their service available to others, such as local business reviews or public social media posts.
  7. Joint offering partners. We may offer co-branded services or experiences or engage in joint-marketing activities with others, including through our conferences or live events.
  8. Government agencies. We receive information from government agencies, including from various tax agencies, such as your tax filing confirmation from the IRS. 
  9. Public information. We collect individual and household demographic information and preference information from publicly available sources, such as open government databases, social media platforms, and others.

From Automatic Data Collection
We, our service providers, and our business partners may automatically log personal information about you, your computer or mobile device, and your interaction over time with the Services, such as:

  1. Device information. We may collect information about your device(s) such as IP addresses, log information, error messages, device type, and unique device identifiers. For example, we may collect IP addresses from you as part of our sign in and security features. 
  2. Usage information. We may collect information about your use of the Revolution Services, such as the pages you viewed, the services and features you used or interacted with, your browser type, and details about any links or communications with which you interacted.
  3. Location information. Certain features in the Revolution Services may collect your precise location information, device motion information, or both, if you or your organization grant(s) us permission to do so through your device settings.
  4. Information stored locally. Some of our web-enabled desktop services and offerings synchronize with the information on your computer. In doing so, we may collect information such as device information, product usage, and error reports. We may also store personal information locally on your device.
  5. Communication interaction data. We or our third-party service providers may collect information from email providers, communication providers and social networks, such as your interactions with our email, text, or other communications (e.g., whether you open and/or forward emails) – we may do this through use of pixel tags (which are also known as clear GIFs), which may be embedded invisibly in our emails.
  6. Online activity data. We may automatically collect certain personal information about your use and interactions with our websites, customers’ websites or e-commerce stores, social media websites, and marketing     campaigns that we or our customers organize, including device information (such as your IP address and unique device IDs), page view information and search results, links, and if you are a customer contact, whether or not a campaign presented or sent to you using our offerings has been viewed, delivered, opened, clicked on, whether it has bounced or was treated as spam.

From Tracking Technologies
We may use common tracking technology tools to collect information about you (“Tracking Information”) so we can provide the experiences you request, recognize your visit, track your interactions, and/or improve our customers’ experiences. For example, with your affirmative opt-in consent, we may use session-replay technologies on certain portions of our Services, such as those provided by LogRocket, that employ software code to record users’ interactions with the Services in a manner that allows us to watch video replays of those user sessions. The replays include users’ clicks, mobile app touches, mouse movements, scrolls and keystrokes/key touches during those sessions. Revolution will take diligent care in order to ensure that no such technology captures sensitive or financial information without your explicit permission. These replays are only designed to help us diagnose usability problems and identify areas for improvement. While our Services may change over time, and we may introduce new features, any new features or changes to our services that materially change processing activities or that collect new and different types of information that result in a change to practices disclosed in this Statement will only be done on the basis of the “Changes” section below.

HOW WE USE YOUR INFORMATION. Unless prohibited by law, regulation, or a contractual obligation, we may use your information, including your Personal Information, for the following purposes:

  1. Account Registration. We may use your name, address, phone number, and email address to register your account for certain Services we provide, and to communicate important information to you. We may obtain additional Personal Information about you, such as address change information, from commercially available sources, to keep our records current. If you set up an administrator account that may be accessed by people other than you, please note that they may see, and have the ability to change, or delete your Personal Information.
  2. Communication and Related Services. We may use your information to communicate with you about our Services, and to give you offers for third party products, and services that we think may be of use to you. Please see below under "What You Can Do to Manage Your Privacy" for the choices you have regarding these communications.
  3. To Improve and/or Develop Services. We will use your information to personalize, or customize your experience, and the Service, develop new features, or services, and to improve the overall quality of Revolution's Services.
  4. To Provide Our Services, and Operate Our Business. We may use your information to operate our business, including providing Services you requested, Services your employer requested, provide you with support related to our Services, and to help us protect our Services, including to combat fraud, and protect your information.
  5. Customer Service, and Technical Support. We may use your name, address, phone number, email address, how you interact with our Services, and information about your computer configuration to resolve questions you may have about our Services, and to follow up with you about your experience. We also offer various Internet chat services, for example, to speak with a Revolution support representative. Internet chat transmissions are encrypted but you should not supply more Personal Information than is required to address your specific issue. A transcript of the session may be retained to resolve questions, or issues related to our Services.
  6. Feedback. We may use any information you volunteer in optional surveys you answer for us and combine them with answers from other customers in order to better understand our Services, and how we may improve them.
  7. Anonymous Information. We may prepare, and share information about our customers with third parties, such as partners, for research, academic, marketing and/or promotional purposes, but only in an aggregated and non-identifiable manner. For example, we may share demographic data that describes the percentage of our customers who use mobile services, or who use a particular operating system.
  8. Revolution Single Sign-On (Revolution Account). Revolution Single Sign-on is a Service that allows you to sign-in to a variety of Revolution Services with a single Revolution account. We will collect certain information for security purposes in order to verify your authorized access to an account, or to reset your password if you cannot access your Revolution account. Some Services may require added security, and you may be asked to provide additional information. The email address, and password that you use to sign up for a Revolution account are your "credentials" that you will use to authenticate with our network. We assign a unique ID number to your credentials to track you, and your associated information. Revolution Services do not allow sharing of accounts between users, or individuals.

Third Party Service Providers. We may share your information, including Personal Information, with third party service providers who perform various functions to enable us to provide our Services, and help us operate our business, such as tax form creation, and distribution (1099s, 1095-Cs,W-2s, etc.), website design, sending email communications, fraud detection, and prevention, customer care, or performing analytics. Our contracts with these third parties require them to maintain the confidentiality of the Personal Information we provide to them, only act on our behalf, and under our instructions, and not use Personal Information for purposes other than the product, or service they're providing to us, or on our behalf.

Responses to Legal Requests. We may share your information with courts,law enforcement agencies, or other government bodies when we have a good faithbelief we're required, or permitted to do so by law, including to meet nationalsecurity, or law enforcement requirements, to protect our company, or torespond to a court order, subpoena, search warrant, or other law enforcementrequest.

Protection of Revolution and Others. We may share account informationand Personal Information when we believe it is appropriate to enforce or applyour products' terms of service and other agreements; or protect the rights,property, or safety of Revolution, our Services, our users, or others. Thisincludes exchanging information with other companies, and organizations forfraud protection. This does not include selling, renting, sharing, or otherwisedisclosing Personal Information of our customers for commercial purposes inviolation of the commitments set forth in this Statement.

Information Sharing Between Revolution Entities. We share yourinformation, including your Personal Information, with, and among ouraffiliates, and subsidiaries, except where prohibited by law, regulation, or acontractual obligation. The protections provided in this Statement apply acrossall Revolution entities. Affiliates and subsidiaries, as used herein, meanscompanies related by common ownership, or control. The reasons why we shareyour information include for our everyday business purposes, such as to processyour transactions, maintain your accounts, operate our business, facilitate Revolutionsign on to your Revolution Account, etc. We will also share your information forus to be able to offer our products, and services to you. We may also shareinformation about your creditworthiness, your transactions, and experience sothat we can operate our business effectively, detect, and prevent fraud, andimprove our Services.

Sale of Our Business. If we sell, merge, or transfer any part of our business, we may be required to share your information. If so, you will be asked if you'd like to stop receiving promotional information following any change of control. Other than as set out herein, we will provide you with notice, and the opportunity to choose when your Personal Information may be shared with other third parties.

 ANALYTICS AND OTHER WEB SITE TECHNOLOGIES. We continuously improve our websites and Services through the use of first- and third-party tracking technologies and other web analytics tools, which help us understand how our visitors use our websites, desktop tools, and mobile applications, what webpages, features and functions they like and dislike, and where they may have run into problems which need to be addressed. 

Google Analytics
We use Google Analytics as described in “How Google uses data when you use our partners' sites or apps.” You can prevent your data from being used by Google Analytics on our websites by installing the Google Analytics opt-out browser add-on here. For enhanced privacy purposes, we also employ IP address masking, a technique used to truncate IP addresses collected by Google Analytics and store them in an abbreviated form to prevent them from being traced back to individual users. Portions of our website may also use Google Analytics for Display Advertisers including DoubleClick which provide interest-based ads based on your visit to this or other websites. You can use Ads Settings to manage the Google ads you see and opt-out of interest-based ads. You can similarly exercise your rights with respect to use of this data as described in the “Exercising Choice” section below. 

Social Media
Some of our websites include social media features, such as Facebook, Google, and Twitter “share” buttons. If you elect to use these features, which are voluntarily, optional, and not required nor requested to use our Services, they may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly –you can clear your browser cache to clear any such cookies or local storage, if any, which may be set by these share buttons.  

Exercising Choice
We do not currently respond to web browser "do not track" signals or similar mechanisms. You may also exercise your rights as follows: The Help Menu on the menu bar of most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, and how to disable cookies altogether. You can still view our websites if you choose to set your browser to refuse all cookies; however, you may need to keep certain cookies enabled to establish an account or to install the Services. 

WHAT YOU CAN DO TO MANAGE YOUR PRIVACY. You can view and edit information that identifies you online through your Revolution Service. How you can access, and control information that identifies you will depend on which Services you use. You have a choice about the use of information that identifies you, marketing communications you receive from us, and our use of certain optional tracking technologies such as Session Replay. In connection with your right to manage your Personal Information you provide to us, you may access, update, change, correct or request deletion of your information either through the Service, or through our customer support. You can reach our customer support by using the contact information provided in the "How to Contact Us" section of this statement.

DATA RETENTION AND ACCESS.
Data Retention.
We keep your Personal Information in a form which permits identification for no longer than needed for the business purposes for which it was collected or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Personal Information processed in the context of a contract with you will be retained by us for the term of the contract and for a reasonable time afterwards as might be required to determine and settle any related claims or meet any legal requirements or obligations(e.g., reporting obligations of income and taxes to a relevant government authority). Where our processing of your Personal Information is based on legitimate interests or compliance with legal obligations, it will be deleted as soon as the applicable underlying purpose has expired. For the avoidance of doubt, certain information, such as maintenance of a W2 or similar, will be maintained based on a legal obligation for reporting purposes and cannot be deleted until such legal obligation of Revolution has been extinguished. Personal Information processed based on your consent will be deleted if and when you withdraw such consent. Unless requested sooner and/or unless otherwise required by applicable law, we reserve the right to delete and/or anonymize your account and associated information at the conclusion of the then-final service term. 

Your Access Rights.
We respect your control over your Personal Information and, upon request, will confirm whether we hold or are processing information that we have collected from you. You also have the right to amend or update inaccurate or incomplete Personal Information, request deletion of your Personal Information, or request that we no longer use it. Where you have created an online account, you can access your account to view, and make changes, or corrections to your Personal Information. Under certain limited circumstances we will not be able to fulfill your request, such as if it interferes with our regulatory or legal obligations, affects legal matters, we cannot verify your identity, or it involves disproportionate cost or effort, but in any event, we will respond to your request within thirty (30) days and provide you an explanation. Please note that for Personal Information about you that we have obtained or received for processing on behalf of a separate, unaffiliatedentity – which determined the means and purposes of processing, all such requests should be made to that entity directly. We will honor and support any instructions they provide us with respect to your Personal Information.

SECURITY OF YOUR INFORMATION. Keeping your Information safe is important to us. We have implemented a security program which includes appropriate and industry-standard technical and organizational measures designed to safeguard and protect the personal, identifiable, and/or confidential information we collect, you upload, and/or otherwise choose to share with us. By way of example, we routinely review our practices against industry standards, use secure methods to transit and store your Personal Information, and conduct suitable security training to our staff (who a replaced under appropriate confidentiality obligations).

CHILDREN’S PRIVACY. Our Services and webpages are intended for general audiences – except in very limited circumstances, under lawful basis and with adequate consents under a payroll arrangement, we do not seek to gather Personal Information from or about persons that are sixteen (16)years of age or younger. If you inform us or we otherwise become aware that we have unintentionally received Personal Information from an individual under the age of sixteen (16), we will delete this information from our records.

CHANGES. From time to time we may change or update our Statement. Provided, however, that if we make material changes to the way we process your Personal Information, we will provide you notice via our Service, or by other communication channels, such as by email, or community post. Please review any changes carefully. If you object to any of the changes, and no longer wish to use our Services, and we cannot otherwise find a way to provide you a services without these changes or otherwise assuage your concerns and you have, in a good faith, a reasonable belief of a material adverse risk to the privacy and security of your Personal Information arising from these changes, you may close your account(s) but may retain information where required under legal or tax-reporting-related purposes. All changes are effective immediately upon posting, and your use of our Service after a notice of material change or posting of an updated Statement shall constitute your consent to all changes.

STATE SPECIFIC RIGHTS.
If you are a resident of the below or certain other states, you may have certain privacy rights. These may include, as applicable, but are not limited to the right to: a) access Personal Information that we collect or retain about you; b) request to correct inaccuracies regarding your Personal Information; c)request deletion of your Personal Information; d) obtain a copy of your Personal Information; and e) opt-out of certain targeted advertising activities (if applicable). Please note that these rights are not absolute, and we may been titled to refuse requests, wholly or in part, where exceptions under applicable law apply.

California Residents 

  1. Scope. This section applies to California residents and describes how we collect, use, and share Personal Information of California residents in our capacity as a “business” under the California Consumer Privacy Act (“CCPA”) and your rights with respect to that Personal Information. For purposes of this section, the term “Personal Information” has the meaning given in the CCPA but does not include information exempted from the scope of the CCPA. Please note that we may claim legal exemptions for certain types of personal information and certain Revolution companies from all or certain parts of the CCPA. In some cases, we may elect to provide a different privacy notice to certain categories of California residents, such as employees and job applicants, in which case that notice will apply instead of this section.
  2. Your California privacy rights. As a California resident, you have the rights listed below. However, these rights are not absolute, and in certain caseswe may decline your request as permitted by law. Unless otherwise specified, these rights are available directly within the Revolution Service, by contacting clientservices@revolutiones.com and/or by contacting privacy@revolutiones.com.
  3. Access. You may request that we provide the following information about how we have collected and used your Personal Information during the past twelve (12) months, where applicable:
    1. the categories of Personal Information we have collected about you,
    2. the sources from which that information was collected,
    3. the business or commercial purpose for collecting, selling, and/or sharing your Personal Information, if applicable
    4. the categories of Personal Information we shared or sold about you, if applicable
    5. the categories of third parties to whom we shared or sold personal information about you, if applicable
     6. the categories of Personal Information we disclosed for a business purpose, and
    7. the categories of third parties to whom we disclosed Personal Information about you for a business purpose.
  4. Request a copy of your Personal Information. You may request a copy of the Personal Information by contacting clientservices@revolutiones.com or via Direct Mail as identified in the How To Contact Us Section above.
  5. Correction. You can edit and correct your Personal Information at any time by changing itdirectly in our Services or by contacting privacy@revolutiones.com.
  6. Deletion. You may have the right, under certain circumstances, to request that we delete the Personal Information you have provided to us. As noted in the Retention provisions above, certain information and records will be maintained by Revolution under a legal obligation (e.g., a W2 for government reporting purposes) until such legal obligation has been extinguished.
  7. Opt-out of Sales and/or Sharing. Revolution does not intentionally or negligently engage in the act of “selling” or “sharing” Personal Information with advertising partners. 
  8. Limit processing of sensitive personal information. We only use sensitive personal information as necessary for our: (1) Service delivery and operations;(2) compliance and protection; (3) research and development; or (4) Service improvement and analytics purposes in accordance with CCPA. If we use sensitive personal information outside the permitted purposes of CCPA, we will provide you with the right to limit processing of sensitive personal information.
  9. Non-discrimination. You have the right to be free from discrimination or retaliation related toyour exercise of any of your California privacy rights.
  10. Verification. In order to protect your personal information from unauthorized access or deletion, we may require you to verify your credentials before you can submit a rights request. If you do not have an account with us, or if we suspect your account has been accessed without your authorization, we may ask you to provide additional personal information for verification. If we are subsequently unable to confirm your identity, we may refuse your rights request.
  11. Authorized agents. You may use an authorized agent to submit a rights request. If you do so, the authorized agent must present signed written authorization to act on your behalf, and you will also be required to independently verify your own identity directly with us and confirm with us that you provided the authorized agent permission to submit the rights request. This verification process is not necessary if your authorized agent provides documentation showing that the authorized agent has power of attorney to act on your behalf under Cal. Prob. Code §§ 4121 to 4130.

Colorado Residents

  1. Scope. This section applies to Colorado residents and describes how we collect, use, and share Personal Data of Colorado residents in our capacity as a business under the Colorado Privacy Rights Act (“CPA”) and your rights with respect to that Personal Data. For purposes of this section, the term “Personal Data” has the meaning given in the CPA but does not include information exempted from the scope of the CPA. Please note that we may claim legal exemptions for certain types of personal information and certain Revolution companies from all or certain parts of the CPA.
  2. Your Colorado privacy rights. As a Colorado resident, you have the rights listed below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law. Unless otherwise specified, these rights are available directly within the Revolution Service, by contacting clientservices@revolutiones.com and/or by contacting privacy@revolutiones.com.
  3. Access. You may request a copy of the Personal Information by contacting clientservices@revolutiones.com or via Direct Mail as identified in the How To Contact Us Section above.
  4. Correction. You can edit and correct your personal information at any time by changing it directly in our Services or by contacting privacy@revolutiones.com.
  5. Deletion. You may have the right, under certain circumstances, to request that we delete the Personal Information you have provided to us. As noted in the Retention provisions above, certain information and records will be maintained by Revolution under a legal obligation (e.g., a W2 for government reporting purposes) until such legal obligation has been extinguished.
  6. No tracking for targeted advertising purposes. Revolution does not intentionally or negligently use your information to engage in targeted advertising.
  7. No profiling. Revolution does not engage in the automated processing of your Personal Data to evaluate, analyze, or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements, to the extent this results in decisions that produce legal or similarly significant effects.
  8. Non-discrimination. You have the right to be free from discrimination related to your exercise ofany of your Colorado privacy rights.
  9. Authentication. In order to protect your Personal Data from unauthorized access or deletion, we may require you to verify your credentials before you can submit a rights request. If you do not have an account with us, or if we suspect that your account has been accessed without your authorization, we may ask you to provide additional personal information for verification. If we are subsequently unable to confirm your identity, we may refuse your rights request.
  10. Sensitive Personal Data. We will not process your sensitive personal data with out your consent or suitable lawful basis.

Connecticut Residents

  1. Scope. This section applies to Connecticut residents and describes how we collect, use, and share Personal Data of Connecticut residents in our capacity as a business under the Connecticut Data Privacy Act (“CDPA”) and your rights with respect to that Personal Data. For purposes of this section, the term “Personal Data” has the meaning given in the CDPA but does not include information exempted from the scope of the CDPA. Please note that we may claim legal exemptions for certain types of personal information and certain Revolution companies from all or certain parts of the CDPA.
  2. Your Connecticut privacy rights. As a Connecticut resident, you have the rights listed below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law. Unless otherwise specified, these rights are available directly within the Revolution Service, by contacting clientservices@revolutiones.com and/or by contacting privacy@revolutiones.com.
  3. Access. You may request a copy of the Personal Information by contacting clientservices@revolutiones.com or via Direct Mail as identified in the How To Contact Us Section above.
